Department of Transportation 2016 Hazardous Materials Regulations Enforcement

In April 2017, the Department of Transportation (DOT) issued a 2016 Annual Civil Penalty Report which showed that the Pipeline and Hazardous Materials Safety Administration (PHMSA), Office of Hazardous Materials Safety (OHMS), and PHMSA’s Office of Chief Counsel processed 42 cases and 256 tickets in calendar year 2016 for violations of Hazardous Materials Regulations (49 CFR Parts 171-180). These actions resulted in the collection of $941,404 in fines. Many of these actions included violations of the HM-232 Transportation Security Plan requirements (49 CFR 172.704 and 172.802), including, among others, failing to develop a security plan, failing to keep a copy of the security plan accessible, failing to update the security plan annually, failing to include an assessment of possible transportation security risks, and failing to provide security awareness training.
